51 all Clearly satisfyed, and Doe order and Decree that the Defend.t John Blomfeild doe forthw.th Deliver unto the Comp.lt Francis Stocket or his Assignes the still in question with the appurtenances to whome the Court are Clearly satisfyed it Does truly belong, and the said Court doe further ord.r & Decree the said John Blomfeild to pay unto the Comp.lt the sume of thirteen hundred and thirty pounds of Tobacco for his Costs in this behalfe Expended Henry Scarborough ag.t This Cause being continued untill this Court in w.ch time the p.lts Richard Pery canc & al Attorney was to pduce a better authority from the Comp.lt The Court doe ord.r that the Cause be Continued untill the next Co.rt and that if the Comp.lts Attorney Doe not then pduce a sufficient authority as the Co.rt shall approve of the Cause to be Dismissed Comannd was given to the sheriff of Charles County that whereas wee did by our Letters Patents und.r our greate seale of our sd Province of Maryland bearing date the seaventh day of September in the yeare of our Lord 1666 for the Considerations therein named grannt unto Walter Beane of our said Province gentl a pcell of land Called Durham lyeing Vade old Pat lib lands F F fol 71 in the woods on the Easteside of the Mamefresh Runn of Portobacco Creeke, Conteyning and then layd out for seaven hundred and fifty acres more or lesse as by o.r sd Grannt Remaining upon Record Relation being thereunto had more fully and more at large it doth and may appeare Now for that wee had long before that time Reserved for our owne use a pcell of land in Charles County called Pangaya Manno.r of w.ch the sd pcell of land is pt and the said Walter Beane being sensible thereof fraudulently pcured our grannt aforesayd to the Disniherizon of us and our heires of the p.rmises and being sensible thereof fraudulently pcured our grannt aforesayd the said Walter Beane being since Deceased, wee doe Comannd you that by good and lawfull men of yo.r Baliwick you make Knowne and give warning to the heires of the said Walter Beane, or any assignes that Claymeth the same und.r him that they be befour us in o.r Court of Chancery the Tenth of February next wheresoever wee shall then be to show Cause if any they have wherefour the said Letters Patent of the aforesayd land as aforesayd made ought not to be Revoaked and adnulled and the same into our hands be seized, and to Doe & Receive what our said Court shall Doe or grannt to be Done in this behalfe and how you shall Execute this p.rcept that you make Knowne to our sd Court at the Day aforesayd and have you there this writ At w.ch Day that is to say the Tenth day of February in the 42.th yeare of the Dominion of Cæcilius &c Annoq Domini 1673 John Allen gentl high sheriff of Charles County Retornes the said writ Endorsed as followeth (vizt) By vertu of this writ I have by John Grubb and Clement Thompson good and honnest men of my Baliwick made Knowne unto the widdow of the within named Walter Beane that she be and appeare at the day and place within Conteyned to show Cause if any she have as by the writ within I am Comannded John Allen sheriff Whereupon Ellino.r Beane widdow of the said Walter being Called appeared by her sonne in law, Mathew Hill of Charles County gentl who surrendered up the afd Grannt of the sd Land Called Durham into the hands of the sd Lord Propry and the Court Ordered the same to be Cancelled w.ch was Done by Tearing off the seale in open Court and farther ordered that the Record of the said Patent be vacated oblitterated & scoured out by the hono.ble the Chancelo.r of this Province and this Court doe adjudge order |
