1672 & Costs Hee findes the said Balley by falce Suggestions to the Court & yo.r Excellency hath Taken out a writt of No Exeat Provinciam against your Pet.r & as appeares (by the costs that he putts in for writts then not sued out) to take out writt of Execucon of the decree onely to vex and your Pet.r with needlesse Charges he being now and over Ready to pay him the said Balley his part of the Decree & Costs without Further needlesse Trouble Your pet.r most humbly prayes that he the said Balley may be ordered to Come and receive his part of the said sume and Costs Decreed without further Trouble and your pet.r ordered to deteyne Nethwayes part in his hands as Attorney to sd Nethway And as in Duety Bound he shall ev.r pray Uppon yuseing the above written Pettition of Cap.t James Neale I doe finde nothing Conteyned therein but w.t is very Reasonable & iust and therefore doe thinke it most Fit that John Balley accept of y.e said Neales Proposition therein menconed without Further Trouble to either party in this businesse Charles Calvert the 4.th of March 1672/3 Toby Wells ag.t This Cause was Continued untill the next Co.rt John Wright Jonathan Hopkins ag.t Andrew Skynner to be subpœnayed to be Examined in this case betweene this John Wright & and the next Co.rt and this Cause to be set Downe for hearing the next Co.rt Richard Snowden John Gould ag.t The Attachm.t continued Joseph Sones Charles James ag.t It is ordered by the Court that the Comp.lts bill be Dismissed for want of a John Homewood Replication and that the Comp.lt pay unto the Defend.t one Thowsand and foure pounds of Tob costs Margaret Penry ag.t If the Replication be not filed within two dayes after the Co.rt the Comp.lts bill is Tho Howell & al ordered to stand dismissed, the Replication was accordingly filed William Smith ag.t The Demurrer in this Cause to be argued the next Co.rt Richd Ladd & al Henry Scarborough ag.t Richard Pery & al Henry Beedle ag.t George Wells These foure Causes were Continued untill y.e next Co.rt George Wells ag.t Henry Beedle Francis Stocket ag.t John Blomfeild |
