317) said Forfeiture wholly from the said Robert And Whereas y.e said doings of y.e said Joseph & his Wife Adm.rx as aforesaid & defts in this Court of Chancery are contrary to Equity & good Conscience & to y.e great damage of y.e said Robert Complt as aforesaid who hath in effect ever paid y.e said last Bond so y.t he y.e said Robert ought not in equity to pay the Remainder in y.e same manner as in y.e Condition is specified but rather to be repaid (if there were Assets) the whole said three bonds with Costs & damages And Whereas y.e said Robert hath therefore prayed & obtained a Writt of Spa & Injunct directed to y.e said Joseph & Wife to oblige them to answer y.e abovesaid bill of Complaint exhibited against them as aforesaid to stay all farther proceedings at comon Law till y.e matter in equity should be determined Therefore this Hon.ble Court of Chancery upon hearing y.e Matter this Ninth day of Octob.r 1695 doth order & decree y.t y.e said Robert Mason Complt as aforesaid shall quietly enjoy & possess to him & his heirs forever the said Tract of land And y.t he shall likewise obtain all Cost & damages in this behalf wrongfully sustained (signed) (loc) (Sigilli) Hen Jowles Chanc |
