278 Att a Court of Chancery held at the Citty of S.t Marys in the Province of Maryland on the 19.th day of of Aprill 1689 before W.m Joseph Esq.r and his associates thereunto authorized and appointed Between Garret Vansweringen of S.t Maryes County Complaynant and Thomas Taylor of Dorchester County Gent and Edward Day who had marryed the Relict & Executrix of Thomas Walker late of Somerset County deceased Defend.ts This Cause comeing this present Day to be heard upon the Complainants Bill and the plea of the Defend.t Taylor and the answer of the Defend.t Day in the presence of the partyes pl.tt & Def.ts and their attornyes on both sides The substance of the Complaynants Bill appeared to bee That the Defend.t Taylor in the year of our Lord 1678 being high Sherriffe of the said County of Dorchester and Collector of the publik tobacco of that County stood indebted to the Complaynant upon the publick account the sume of Fourteen Thousand pounds of Tobacco payed in the said County of Dorchester And the Complainant being at the same tyme indebted to W.m Stevens Esq.r in the sume of 6000.tt of tobacco charged upon the sayd Defd.t Taylor two severall Notes payable to the said persons for the said severall sumes w.ch said Note for payment of the said 6000.tt to the said W.m Stevens the said Thomas Taylor accepted and paid accordingly and by a Note under his hand obliged himselfe to pay to the said Walker upon the Complaynants account the other 7000.tt tobacco & the said Walker promised to give the Comp.lt creditt for soe much ag.t the debt afsd due from the p.lt his said Bill to be cancelled butt before the said Taylor paid the said 7000.tt tobacco to the sd Walker the said Walker dyed haveing first made his wife his sole Executrix who after intermarryed the Defend.t Day who demanded the said debt of 7000.tt of the s.d Defend.t Taylor But it soe happened that before the said Day had demanded the debt afsd of the said Taylor there happened a suite in Law between the Comp.lt & the Defend.t upon a Bond of Fourty Two Thousand pounds of Tobacco wherein the said Taylor was bound w.th and as security for one John Quigley deceased to the Comp.lt for the p.rformance of a certain Contract between the said Comp.lt and the Said Quigley w.ch the said Quigley had broke w.ch said suite between the s.d complaynant & Taylor was afterwards by the Mediacon of Freinds Composed Where^u^pon the said Taylor desired the Comp.lt to give him a releas w.ch he did But Not intending That the same |
