272 George Curwen maketh oath That upon the Thirteenth day of Aprill 1682 he went to the dwelling house of Maj.r Boarman then high sheriffe of S.t Maries County where Joseph Tilley was a prisoner and by vertue of a Letter of Attorney under the hand and seale of George Parker bearing date the Eighth day of Aprill 1682 did demand of the said Joseph Tilley to pay the sume of Twenty thousand pounds of Tobacco due to be paid by the said Tilley to the said Parker by vertue of a certaine Decree out of the hono.ble Court of Chancery served upon him by James Crauford in the month of September 1680 And the said Joseph Tilley then said That M.r Parker has cheated him the said Tilley sufficiently already And that he the said Parker shall take noe Advantage of the said Tilleys words now For he the said Tilley shall not say any thing at all to it till such time as he should have Councell assigned him to speake for him And then wee shall talke with him the said Parker And that he the said Curwen at the said day and time aforesaid Did likewise demand of him the said Joseph Tilley if he would pay the sume of Twelve thousand six hundred fifty & two pounds of Tobacco this for Cost of suite allowed by ^to^ the said Parker by the said Decree And the said Tilley then said That he must know whether this be the time limitted for the payment of it before he should say any thing to it And that he the said Curwen upon the said day and time abovesaid after he had demannded said Tilley and had received the answer of him the said Tilley in manner abovesaid he did tender unto the said Tilley a Lre of Attorney bearing date the Eighth day of Aprill 1681 And demanded of him the said Tilley to signe & seale the same seizin of all such Messuages tenements or dwelling houses orchards yards gardens lands & premisses with the appurtennces menconed and expressed in the said Decree If To be ordered and decreed to the said Parker for want of payment of the said sume of Twenty thousand pounds of Tobacco And the said Tilley altogether refused to signe seale or to looke upon the said Lre of Attorney or to have any thing to doe with it George Curwen Juravit die 19.o April is 1682 Coram me Philip Calvert Wee whose names are hereunto subscribed Inhabitants neare Hunting Creeke in Calvert County Doe certify all whome it doe or may concerne ^That^ as the dwelling house where Joseph Tilley lately lived neere Hunting Creeke in Calvert County doth very ninth runn to ruine and decay in soe much That if speed |
