(206 Keeping would have delivered the same againe to the deft being not able to keepe the same goeing w.thout the defts help w.ch the def.t not doubting of the Receiveing the goods aforesaid and soe furnished the said Deery w.th Liquors goods and Provisions for w.ch hee was not then paid and by that Meanes had Disfurnished himself and the said house hee hyred of Cordea for a brewhouse on purpose and since had made little or noe use of it that the said Deery dyeing as aforesaid the said house by carelessnesse of Deeryes and the Comp.lts sarvants who were left there in posession thereof was burnt and had not he deft depended on the said goods hee might have accepted his house againe as Deery offered and followed ordin.ry Keeping againe and in probibility have p.rserved the same from fire & soe not onely that Losse happened but Expecting the said goods and to set up a Brewhouse hee devised himself of all Imployment by w.ch and by the Comp.lts many scandalls that the def.t was indebted to him the Comp.lt in such great sumes as aforesaid the def.t suffered much in his Credit Yet was hee the def.t responcible enough to pay the Comp.lt or any pson Else what hee had Justly owed them and had left in the hands of M.r Thomas Taylor sheriffe of Dorchester County aforesaid Twenty thousand pounds of Tobacco w.th w.ch hee Intended to have payd most part of the said bond and in his hands the same remained all that yeare undisposed of by the defend.t And had hee not Kept the same for that purpose to avoyd the forfeiture of the said bond the same would have paid and discharged most of y.e debts the deft owed and for w.ch hee was since sued and hee said hee Could have well paid for the said goods but hee ought to have had the said goods deliv.rd him to see if they were in Quantity and Quallity according to the said Bond and hee had noe reason to trust the Comp.lt w.th Tobacco before hee had the said goods haveing alsoe sufficiently Experienced the Comp.lts honesty in those Cases Beleived that the Comp.lt never intended to put the said goods ashoare according to the said bond but onely p.rtended soe to doe to delude the Deft and get from him a Coasting boate w.ch formerly was Deerys and then belonged to the deft as his Adm.r for the Comp.lt Cuningly sent a Letter for the same p.rtending to help to bring the defts goods a shoare w.ch the deft Lent him w.ch when hee had gott hee detained the same and Carryed w.th his shipp to Virginia and hath not yett returned the same and for w.ch the Deft had beene forced to bring his action att Lawe And with the Generall Traverse the Defend.t Concluded his Answere To w.ch answere of the said Deft the Comp.lt Replyed & the matter |
