156) or carryed away servants belonging to y.e said Thomas But confesse y.e arbitrato.rs delivered these Defend.ts the bonds of y.e plts of three hundred ^thousand^ pounds of tobacco which they have put in suite That these Defend.ts entered upon y.e plantacon called Quarter and upon y.e servants stock and hopp and that there was about forty barrells of Corne and about thirty hoggsheads of tobacco That these Defendants received the same and ought not to be accomptable for the same to the Comp.lt Thomas That These Defendants Cutt downe timber by ord.r of the Comp.lt Damoras That they had possession delivered them by the Comp.lt Damoras and have her release and ought not to be accomptable to y.e Complts And denye they detaine any provisoe or wearing apparrell belonging to the Complt Thomas and that the Comp.lts accompt exhitted before y.e Judge Testamentary was sett a side by y.e award of Collon.ll Taylor and Collonell Burges and deny they possessed themselves of any part of the psonall Estate more then what ^was^ delivered And co^n^fesse y.e Comp.lt tendered bills to the said Defendants w.ch were desperate & that these Defendants refused to allow y.e same That y.e Comp.lts Wanting a Woman servant did Exchange a manservant named Booth to worke for these Defendants soe long as the Woman servant should stay and worke w.th y.e Comp.lts and the said Woman servant belonging to the said Comp.lt Thomas the Comp.lt left with the ^said^ Complt Thomas his wife to cure her of a soare legg To which answere of the Defendants there being much new matter these Comp.lts replyed specially and say That the Defendants by Sinister and fraudulent meanes caused the Comp.lt Damoras to signe and seale severall papers the Contents of which she never heard read and utterly denye the said receceipts or released Can any way by Law discharge these Defendants That the Complt Thomas & Def.t Edward submitted all difference to the Chancellour who awarded the Defendant Edward to pay unto the Complt Thomas Tenn thousand seaven hundred forty six pounds of tobacco That there was Nine thousand pounds of tobacco more due upon y.e accompt but by neglect of y.e Clerke was Omitted out of y.e accompt upon the Chancello.rs award and denye the said Defendants paid y.e said tenn thousand seaven hundred forty six pounds of tobacco to these Comp.lts or either of them That the Defendants inticed y.e Complt Damoras to give discharge for y.e same and denye her ' receipt can discharge the said bond That the Comp.lts exhibitted their Just accompt of Wyatts estate after the will was Damnd and upon Dorsey his owne [illegible] hath allowed thirty eight thousand Eight hundred and Eighty pounds of tobacco and denye the arbitrato.rs have allowed by their award duely the sume in the schedule to the Defendants answere annexed That these Comp.lts and Defend.ts entered into bonds of Three hundred thousand pounds of Tobacco to stand to the award of Collonell Taylor and Collonell Burges to decide y.e differences concerning the estate of Nicholas Wyatt and noe otherwises and that they were not permitted to Exhitted any accompt before y.e Arbitrato.rs nor that the said Comp.lts Just accompt exhitted |
