certified by the clerk of the court or by a judge in whose court
the conviction is had, shall be conclusive evidence of such
conviction. (2)  His certificate has been secured by fraud or
deceit practiced upon the Board. (3)  Unethical conduct, or gross negligence in his
profession. (4)  Practicing while knowingly suffering from a
contagious or infectious disease. (5)  Advertising professional methods or professional
superiority. (6)  Practicing the fitting of hearing aids under a
false or alias name. (7)  Any violation of the provisions of this subtitle. (8)  Directly or indirectly giving or offering to give
money or anything of value to any person who advises another in a
professional capacity as an inducement to influence the person,
or to have the person influence others, to purchase, or contract
to purchase, any product or service of a hearing aid dealer or
fitter, or to refrain from dealing in the products or services of
competitors. (9)   Selling a hearing aid to any person unless within
the preceding six months that person has been examined by an
otolaryngologist, an otologist, any licensed physician, and a
written recommendation for a hearing aid has been made by the
physician. This paragraph does not apply to replacement of a
hearing aid or to the sale to any person 18 years of age or older
who waives in writing such examination. (10)   Selling a hearing aid to a person by
door-to-door solicitation. This does not apply to a solicitation
made at the request of the prospective purchaser, or if the
seller has been referred by a third party, or in response to an
inquiry from the prospective purchaser or a hearing aid user. (11)  PERFORMING UNFAIR OR DECEPTIVE TRADE PRACTICES
AS DEFINED IN § 13-301 OF THE COMMERCIAL LAW ARTICLE. Article - Commercial Law 13-401. (a) A consumer who is subjected to a violation of this
title may file with the division a written complaint which
states: (1) The name and address of the person alleged to
have committed the violation complained of;
