SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Education
[7-303.
(a) Each county board and the Mayor and City Council of
Baltimore may establish schools in any county or Baltimore City
to be known as parental schools for children 6 years old or older
and under 16 who are habitual truants from school or from
instruction.
(b) Two or more county boards may establish a parental
school for their joint use.
(c) The juvenile court that has jurisdiction may commit a
habitually truant child to any parental school for the city or
county in which the child resides, but a child who is convicted
of any offense other than truancy may not be committed to a
parental school.]
7-303.
(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
(2) "DISRUPTIVE CLASSROOM BEHAVIOR" MEANS EXCESSIVE
TRUANCY, EXCESSIVE USE OF ALCOHOL AND DRUGS, VANDALISM, CONTINUAL
DISRESPECT, INSUBORDINATION, AND OR HOSTILITY TOWARDS SELF,
PEERS, AND SCHOOL EMPLOYEES, AND A RECORD OF ACADEMIC
UNDERACHIEVEMENT, AS RELATED TO ABILITY.
(3) "SPECIAL PROGRAMS" MEANS AN INTERVENTION PROGRAM
IN SEPARATE CENTERS OR IN-HOUSE PROGRAMS THAT, IN ADDITION TO
ACADEMIC CONCERNS, IS CHARACTERIZED BY SMALL CLASS SIZE AND
CONTINUING COUNSELING AND GUIDANCE.
(B) (A) EACH COUNTY BOARD OF EDUCATION AND THE MAYOR AND
CITY COUNCIL OF BALTIMORE BOARD OF SCHOOL COMMISSIONERS OF
BALTIMORE CITY SHALL MAY ESTABLISH A SPECIAL PROGRAM SPECIAL
PROGRAMS IN THE COUNTY OR BALTIMORE CITY FOR STUDENTS IN THE
PUBLIC SCHOOL SYSTEM WHO EXHIBIT DISRUPTIVE CLASSROOM BEHAVIOR.
