(House Bill 293)
AN ACT concerning
Surface Mining - Financial Security
FOR the purpose of requiring that a bond or other security filed
with the Department in connection with a surface mining
permit may not be canceled except after certain notice;
requiring that a surface mine operator shall provide a
substitute bond or other security prior to cancellation of
an outstanding bond or security; and generally relating to
bonds or other securities in connection with surface mining
permits.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Natural Resources
7-6A-09.
(c) In the absence of any of these findings, a permit shall
be granted. However, no permit becomes effective until the
operator has deposited with the Department an acceptable
performance bond or other security pursuant to § 7-6A-20 of this
subtitle. If at any time the bond or other security, or any part
of it, lapses for any reason other than a release by the
Department, and the lapsed bond or security is not replaced by
the operator [within 30 days after notice of the lapse], PURSUANT
TO § 7-6A-20, the permit to which it pertains automatically
