(48) days of racing or any part thereof. The discretion of the Commission on the award of all such dates shall be final, and the award of all dates shall constitute a license and not a
franchise. 9. Said Commission may in its discretion meet subsequent to the
first day of December and award dates for racing within the
limits hereinbefore provided on applications submitted to [to]
it, provided that the days so awarded in no way conflict with the
further provisions of this article; and provided, further, that
no license for a race meeting shall issue prior to the payment of
the fees therefor at the rate hereinbefore provided. 14. (b) Every person, firm, association or corporation licensed
to hold racing meetings in the State of Maryland under the
provisions of § 7 of this [Article] ARTICLE, shall in addition to
the other taxes and fees imposed under the provisions of said
article, pay annually to the Maryland Agricultural Fair Board the
sum of twelve thousand dollars ($12,000.00), and to the Maryland
Horse Breeders' Association the sum of three thousand dollars
($3,000.00). 17. (a)  (2) Notwithstanding any other provisions of this
article governing the terms and conditions relating to racing
dates, the [harness racing board] HARNESS RACING BOARD, after
having denied, revoked, or suspended a license pursuant to
Section 7 or Section 10 of this article, may assign some or all
of the harness racing dates previously awarded, or which could
have been awarded, to any person, association, or corporation
licensed under this article to conduct racing. An assignment of
dates may only be made with the consent of the person,
association, or corporation to which the assignment is made. (b)  (1) Each licensee licensed under the provisions of this
section shall at its option be permitted to avail itself of the
pari-mutuel betting privileges granted in this section, retaining
for its own use 13 1/2% of the regular mutuel pool, 15.5 percent
of the two horse multiple mutuel pool, if any, and 21 1/2 percent
of the three or more horse multiple mutuel pool, if any, of all
money wagered not in excess of $125,000 daily average and 11
percent of the regular mutuel pool and 13 percent of the two
horse multiple mutuel pool, if any, and 19 percent of the three
or more horse multiple mutuel pool, if any, of all money wagered
in excess of $125,000 daily average on all races conducted by it
during the year. Each licensee shall pay to the [harness racing
board] HARNESS RACING BOARD for the use of the State an annual
tax at the rate of 3 1/2% of all money wagered not in excess of
$125,000 daily average, and 6% of all money wagered in excess of
$125,000 daily average on all races conducted by it during the
