HARRY HUGHES, Governor
(3)  The State's Attorney may appoint additional
assistant. State's attorneys as approved by the Board of County
Commissioners and provided for in the Garrett County budget. (4)  The assistant State's attorneys shall serve at
the pleasure of the State's Attorney. The assistant State's
attorney's salary is not less than $10,000 a year. (5)  (I) SUBJECT TO THE APPROVAL OF THE BOARD OF
COUNTY COMMISSIONERS AND IF PROVIDED FOR IN THE GARRETT COUNTY
BUDGET, THE STATE'S ATTORNEY MAY APPOINT INVESTIGATORS. (II)  A STATE'S ATTORNEY'S INVESTIGATOR: 1.   IS AT ALL TIMES UNDER THE SUPERVISION
AND SUBJECT TO THE RULES AND REGULATIONS OF THE STATE'S ATTORNEY; 2.   SHALL PERFORM THE DUTIES DESIGNATED BY
THE STATE'S ATTORNEY; 3.   SHALL TAKE AN OATH OF OFFICE
SUBSCRIBED TO BEFORE THE CLERK OF THE CIRCUIT COURT FOR GARRETT
COUNTY; 4.   SHALL HAVE AT LEAST: A.   10 YEARS LAW ENFORCEMENT EXPERIENCE IN
A FEDERAL, STATE, OR COUNTY LAW ENFORCEMENT AGENCY; OR B.   AT LEAST 5 YEARS LAW ENFORCEMENT
EXPERIENCE IN A FEDERAL, STATE, OR COUNTY LAW ENFORCEMENT AGENCY
AND AN ASSOCIATE OF ARTS OR BACHELOR OF ARTS DEGREE IN POLICE
SCIENCE OR CRIMINOLOGY FROM AN ACCREDITED INSTITUTION OF HIGHER
EDUCATION; 5.  HAS THE POWER TO ARREST PERSONS
COMMITTING OFFENSES OR CRIMES IN GARRETT COUNTY; 6.  MAY EXERCISE THE GENERAL POWERS OF A
PEACE OFFICER IN GARRETT COUNTY AND MAY WEAR AN APPROPRIATE
METALLIC BADGE AS PRESCRIBED BY THE STATE'S ATTORNEY; AND 7.   MAY POSSESS AND CARRY FIREARMS OR
OTHER WEAPONS AS REQUIRED BY THE STATE'S ATTORNEY. (III)   INFORMATION OBTAINED BY A STATE'S
ATTORNEY'S INVESTIGATOR, AS A RESULT OF ANY INVESTIGATION, SHALL
BE KEPT CONFIDENTIAL, AND MAY NOT BE DIVULGED EXCEPT UNDER ORDER
BY A COURT OF RECORD OF THIS STATE, OR FOR THE PROPER
ADMINISTRATION OF JUSTICE. (IV)   THE REQUIREMENTS OF ARTICLE 41, SECTION
70, OF THE CODE RELATING TO THE TERMINATION OR REVOCATION OF
COMMISSIONS OF SPECIAL POLICEMEN 70A, OF THE CODE RELATING TO THE
POLICE TRAINING COMMISSION APPLY TO THE POSITION OF STATE'S
ATTORNEY'S INVESTIGATOR IN GARRETT COUNTY.
