(D) AS USED IN THIS SECTION, "ELDERLY AND HANDICAPPED
PERSON" MEANS ANY PERSON WHO, BY REASON OF ILLNESS, INJURY, AGE,
CONGENITAL MALFUNCTION, OR OTHER PERMANENT OR TEMPORARY
INCAPACITY OR DISABILITY, IS UNABLE TO USE MASS TRANSIT
FACILITIES AND SERVICES AS EFFECTIVELY AS A PERSON WHO IS NOT SO
AFFECTED.
(E) THE PROVISIONS OF SUBSECTION (C) SHALL NOT APPLY TO
CHARTER BUS SERVICE RENDERED BY THE MASS TRANSIT ADMINISTRATION.
(F) A PERSON CONVICTED OF VIOLATING SUBSECTION (C) IS
SUBJECT TO A FINE OF NOT MORE THAN $500 $250 FOR EACH OFFENSE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Section is
not to be construed to prohibit enforcement of any other general
or local law or ordinance, rule or regulation of a State or local
authority or agency, which is not inconsistent with the
provisions of this Section.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.

CHAPTER 117
(Senate Bill 271)
AN ACT concerning
Merit System - Transferred Employees
FOR the purpose of transferring certain contractual employees of
the Income Maintenance Administration, Department of Human
Resources, and of local departments of social services to
the State classified service; providing that employees
transferred under this Act be given credit for prior years
of service for certain purposes, that they not receive
diminution in compensation solely as a result of this
transfer, and that they participate in the State Employees'
Pension System; requiring certain testing and
recommendations prior to the transfer of employees under
this Act; and providing that this Act applies to only those
positions proposed for conversion to the State classified
service in the Fiscal Year 1984 Governor's Allowance Budget.
