7B. (A)  CHECKS ISSUED BY THE TREASURER WHICH ARE RETURNED TO
THE COMPTROLLER AS UNDELIVERABLE SHALL BE HELD IN SAFEKEEPING FOR
A PERIOD NOT EXCEEDING 30 DAYS. DURING THIS TIME A DILIGENT
EFFORT TO DETERMINE THE PROPER ADDRESS OF THE PAYEE SHALL BE MADE
IN ORDER TO DELIVER THE CHECK. (B)  AFTER 30 DAYS THE COMPTROLLER SHALL DELIVER THE CHECKS
TO THE TREASURER AND THE TREASURER SHALL CANCEL THE CHECKS AND
REQUEST THE COMPTROLLER TO WARRANT THE AMOUNT AND ACCOUNT FOR IT
IN AN ACCOUNT ENTITLED "UNDELIVERABLE CHECKS FUND". (C)  UPON REQUEST.. THE TREASURER MAY ISSUE A CHECK TO
REPLACE ONE CANCELED AND WARRANTED INTO THE UNDELIVERABLE CHECKS
FUND UPON A WARRANT OF THE COMPTROLLER CHARGED AGAINST THE
UNDELIVERABLE CHECKS FUND. (D)  ANY FUNDS WARRANTED INTO THE UNDELIVERABLE CHECKS FUND
THAT ARE REQUIRED TO BE RETURNED TO THEIR ORIGINAL SOURCE IN
COMPLIANCE WITH A FEDERAL OR STATE LAW, OR AS MAY BE DEEMED
PROPER BY THE TREASURER, SHALL BE DISBURSED OR TRANSFERRED UPON
WARRANT OF THE COMPTROLLER AND CHARGED AGAINST THE UNDELIVERABLE
CHECKS FUND. (E)  UNDELIVERABLE CHECKS WHICH HAVE NOT BEEN CLAIMED WITHIN
7 YEARS OF THE DATE OF ISSUE ARE VOID. AT THE END OF EACH FISCAL
YEAR THE TREASURER SHALL IDENTIFY THE CHECKS WHICH HAVE REMAINED
IN THE UNDELIVERABLE CHECKS ' FUND FOR A PERIOD OF 7 YEARS AND
WHICH ARE VOID AND SHALL SECURE FROM THE COMPTROLLER A WARRANT
TRANSFERRING THE FUNDS HELD FOR THESE CHECKS TO THE GENERAL FUND
OF THE STATE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983. Approved May 10, 1983.
