FOR the purpose of authorizing requiring the Secretary of Health
and Mental Hygiene to conduct those inspections required or
necessary to enforce the provisions of the Maryland Water
Quality Laboratory Certification Act, and eliminating a
requirement that the Secretary have each water quality
laboratory inspected annually inspect each water quality
laboratory at least triennially.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Health - Environmental
9-1003.
[(a)] The Department shall:
(1) Adopt rules and regulations to carry out the
provisions of this subtitle;
(2) Establish a proficiency testing program to test
the performance of any water quality laboratory; [and]
(3) Set standards for:
(i) Demonstrating satisfactory performance in a
proficiency testing program; and
(ii) Conducting the program[ . ]; AND
[(b) The Secretary shall have each water quality
laboratory inspected annually AT LEAST TRIENNIALLY.]
(4) CONDUCT THOSE INSPECTIONS REQUIRED OR NECESSARY
TO ENFORCE THE PROVISIONS OF THIS SUBTITLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
