authorized amount established in
the budget for the State Department
of Education at any one time during
F.Y. 1984, except that if there is
a budget transfer from the
Department of Health and Mental
Hygiene to the Department of
Education for the purpose of
funding educational programs in the
Department of Health and Mental
Hygiene, the limit may be exceeded
by the number of positions included
in the transfer. A reduction in
the Department of Health and Mental
Hygiene corresponding to the
increase in the Department of
Education would be mandated in that
event. The Superintendent of
Education should utilize his
prerogatives under Education
Article, Section 2-103 to implement
this provision, provided, however,
that any authorized job or position
to be filled above the 1,342
ceiling, including full-time
contractual positions, is approved
by the Board of Public Works and
counted against the limitation
imposed by the General Assembly.
The establishment of new jobs or
positions not authorized in the
F.Y. 1984 budget shall be subject
to Article 78A, Section 16B(a) and
the limitation imposed by the
General Assembly.
