3046 COUNTY LOCAL LAWS
AN ACT to amend Article V, title "Abandonment and Closing of
Roads and Drainage Rights-of-Way", of Chapter 49, title "Streets
and Roads", of the Montgomery County Code, 1972, as amended, by
repealing and reenacting with amendments Subsection 49-62(a) of
Section 49-62, title "By Resolution of Council; Hearing,
Recommendations, etc.", to authorize the County Council to
abandon or close roads, crosswalks, pedestrian walkways, water
mains, sanitary sewers, storm sewers and storm drainage
rights-of-way in previous or current public use; by repealing and
reenacting with amendments Subsection 49-63(a) of Section 49-63,
title "Findings of Council; Prerequisites", by providing that the
findings of the County Council be based upon the record of the
proceedings as well as the report and recommendations of the
County Executive and by providing for oral argument before the
County Council; by repealing and reenacting with amendments
Section 49-65, title "Record", by authorizing the County Attorney
to show approved subdivision plats reflecting abandonments
authorized by the County Council; and by adding a new Section
49-67A, title "Abandonment of Previously Unused Road, Drainage,
and Other Rights-of-Way" to authorize the Montgomery County
Planning Board to abandon roads, crosswalks, pedestrian walkways,
water mains, sanitary sewers, storm sewers and storm drainage
rights-of-way which have not previously been in public use; and
to amend Article II, title "Plats", of Chapter 50, title
"Subdivision of Land", of the Montgomery County Code, 1972, as
amended, by repealing and reenacting with amendments Subsection
50-15(a) of Section 50-15, title "Streets, etc., Dedicated to
Public Use; Abandonment of Subdivisions", to conform Subsection
50-15(a) with the amended abandonment procedures of Article V,
title "Abandonment and Closing of Roads and Drainage
Rights-of-Way" of Chapter 49, title "Streets and Roads".
Effective Date June 28, 1982.

BILL NO. 76-81
AN ACT to add a new Chapter 24B, title "Home Owners'
Associations" to the Montgomery County Code 1972, as amended, for
the purpose of requiring that certain meetings be open to all
members of home associations, and providing for nonpreferential
treatment of candidates for directors of home owners'
associations, and relating generally to home owners'
associations.
Effective Date July 26, 1982.
