FOR the purpose of requiring the Department of Natural Resources
to assess a nonresident of this State a certain surcharge on
the issuance of certain fishing and crabbing licenses in
this State; prohibiting the Department from assessing a
surcharge on a certain nonresident sporting license to catch
crabs; and generally relating to fees and surcharges for the
issuance of certain fishing and crabbing licenses to a
nonresident of this State.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Natural Resources
4-213.
(A) EXCEPT AS OTHERWISE PROVIDED IN THIS SECTION, THE
DEPARTMENT SHALL ASSESS ANNUALLY ON EVERY NONRESIDENT APPLICANT
FOR ANY LICENSE LICENSES UNDER SUBTITLES 7, 8, AND 9 OF THIS
TITLE, IN ADDITION TO THE NORMAL APPLICATION FEE FEES IMPOSED BY
STATUTE, RULE, OR REGULATION, A SURCHARGE WHICH CUMULATIVELY
SHALL BE THE GREATER OF:
(1) AN AMOUNT EQUAL TO THE DIFFERENCE BETWEEN THE
TOTAL FEE OF FEES CHARGED A MARYLAND RESIDENT TO ENGAGE IN LIKE
FISHING ACTIVITIES IN THE STATE OF RESIDENCE OF THE NONRESIDENT
APPLICANT, AND THE NORMAL LICENSE FEE FEES FOR THE FISHING
ACTIVITY ACTIVITIES IN MARYLAND; OR
(2) $350.
(B) THE DEPARTMENT MAY NOT IMPOSE A SURCHARGE UNDER THIS
SECTION FOR THE ISSUANCE TO A NONRESIDENT OF A SPORTING LICENSE
TO CATCH CRABS UNDER § 4-804(G) OF THIS TITLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
