AND MAY NOT BE ELIGIBLE FOR REAPPOINTMENT AS CHAIRMAN FOR THE
FOLLOWING YEAR. THE COUNCIL SHALL ELECT, BY MAJORITY VOTE, ONE
OF ITS MEMBERS TO SERVE AS CHAIRMAN. THE TERM OF OFFICE OF THE
CHAIRMAN SHALL BE 1 YEAR AND SHALL BEGIN ON JULY 1 OF EACH YEAR.
THE CHAIRMAN SHALL NOT BE ELIGIBLE FOR ELECTION TO A CONSECUTIVE
TERM. Any vacancies occurring in any term shall be filled by the
Governor's appointment with the advice of the Secretary of
Licensing and Regulation for the remainder of the term. The
members shall be compensated on a per diem basis as set forth in
the annual State budget from time to time, and they shall be
allowed reasonable expenses for travel in accordance with the
standard travel regulations.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.

Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 289.
This bill increases the land reclamation fee from $40 to $75
per acre for each coal operator applying for a permit to mine
coal by open-pit or strip method, and repeals the requirement
that the State match this fee and deposit it in the Bituminous
Coal Open-Pit Mining Reclamation Fund. Fee revenues are to be
used to backfill, grade, and plant areas affected by open-pit
mining.
House Bill 227, which was passed by the General Assembly and
signed by me on May 31, 1983, accomplishes the same purpose.
Therefore it is not necessary for me to sign Senate Bill 289.
