Article 62 - Marriages
14.
(a) The clerk of the court shall receive $10 for every
license issued and for the performance of the other duties
required by this article. Of this $10, $5 shall be retained by
the clerk, and $5 shall be paid to the county treasurer for use
as general funds.
(B) (1) IN ADDITION TO ANY OTHER PROVISION OF THIS SECTION,
ANY COUNTY OR ANY GROUP OF 2 OR MORE COUNTIES MAY SET AN
ADDITIONAL FEE OF UP TO $15 FOR EACH LICENSE.
(2) THE PROCEEDS FROM THE ADDITIONAL FEE SHALL BE
USED TO FUND DOMESTIC VIOLENCE PROGRAMS.
(c) (1) In Baltimore City, in addition to all other fees
imposed under this article, the clerks may be directed by
ordinance of the Mayor and City Council to receive [an additional
$5] UP TO $15 for every license issued.
(2) The clerk shall remit monthly the proceeds of the
additional fee to the Mayor and City Council of Baltimore City.
(3) The proceeds shall be used to fund domestic
violence programs which have 24 hour intake ability.
(d) (1) In Montgomery County, in addition to all other fees
imposed under this article, the clerk of the court may be
directed by resolution of the county council to receive [$5] UP
TO $15 for every license issued.
(2) The clerk shall remit the proceeds of this
additional fee monthly to the director of finance of Montgomery
County.
(3) The proceeds shall be used in addition to
designated federal, State, and county funds in funding battered
spouse shelters and domestic violence programs.
(4) The county executive shall prepare an annual
report on the disposition of fees collected under this article.
The report shall be available no later than December 1 subsequent
to the fiscal year being reported.
(e) (1) In Baltimore County, in addition to all other fees
imposed under this article, the clerk of the court may be
directed by resolution of the county council to receive [$10] UP
TO $15 for every license issued.
(2) The clerk shall remit the proceeds of this
additional fee monthly to the director of finance of Baltimore
County.
