FOR the purpose of requiring that Mental Retardation and
Developmental Disabilities Administration to provide certain
nonresidential services for mentally retarded individuals;
providing that these services shall include certain
transportation; requiring that these services be funded in a
certain manner; clarifying language and generally relating
to the funding of services to mentally retarded individuals
providing for a certain limitation on the amount of local
funds that a local government is required to provide as part
of the operating cost for nonresidential services provided
to mentally retarded individuals by the Mental Retardation
and Developmental Disabilities Administration; and relating
generally to local government funding of nonresidential
services provided to mentally retarded individuals.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Health - General
7-205.
(a) (1) The Administration [may] SHALL administer a
program of STATE FUNDED nonresidential services, including day
care centers for mentally retarded individuals, [and] a
program of prevention and treatment of mental retardation, AND
DAILY TRANSPORTATION TO AND FROM DAY-CARE CENTERS LICENSED BY THE
STATE FOR THOSE MENTALLY RETARDED INDIVIDUALS WHO ARE ENROLLED
PROPERLY IN A DAY-CARE CENTER.
(2) [For these programs, the ] THE Administration
[ may use the] SHALL FULLY FUND THESE PROGRAMS WITH STATE AND
FEDERAL funds that are appropriated for the financial support of
[day care centers] COMMUNITY SERVICES for mentally retarded
individuals [ as a part of general local health services] in
the State budget. [If the funds are used in that manner, the
proportion of State, AND federal, and local funds,
respectively, shall be that proportion specified for the
financing of minimum health services. THE LOCAL FUNDING
REQUIREMENT SHALL BE LIMITED TO 25 PERCENT OF THE 1984 FISCAL
YEAR COST OF OPERATING A PROGRAM OF NONRESIDENTIAL SERVICES,
INCLUDING DAY ACTIVITY PLACEMENT PROGRAMS, FOR THE MENTALLY
RETARDED INDIVIDUALS.]
(b) [(1) The Administration shall provide funds for daily
transportation to and from the day-care centers licensed by this
