(III) 250,000 GALLONS OR UNDER...........$100
(IV) 500,000 GALLONS OR UNDER.............$150
(V) OVER 500,000 GALLONS ...........$200; and
(3) Submits to the Secretary:
(i) A renewal application on the form that the
Secretary requires; and
(ii) Satisfactory evidence of compliance with
the requirements of this section for renewal.
(D) (1) THE RENEWAL FEE UNDER THIS SECTION SHALL BE BASED
ON:
(I) IF THE LICENSEE HAS A MANUFACTURING
FACILITY LOCATED IN THIS STATE, THE ANNUAL PRODUCTION OF ANY
FROZEN DESSERT OR FROZEN DESSERT MIX IN THIS STATE; AND
(II) IF THE LICENSEE HAS A MANUFACTURING
FACILITY NOT LOCATED IN THIS STATE, THE ANNUAL SALES OF ANY
FROZEN DESSERT OR FROZEN DESSERT MIX IN THIS STATE.
(2) THE ANNUAL FEE UNDER THIS SECTION SHALL BE
ASSESSED AS FOLLOWS:
(I) 0 TO 25,000 GALLONS....................$10
(II) 25,001 TO 100,000 GALLONS..............$50
(III) 100,001 TO 250,000 GALLONS...........$100
(IV) 250,001 TO 500,000 GALLONS............$150
(V) OVER 500,000 GALLONS...................$200
[(d)] (E) The Secretary shall renew the license of each
licensee who meets the requirements of this section.
[(e)] (F) A license is not transferable.
[4-821.
Regardless of the name under which it is represented, a
person may not sell or advertise for sale any frozen substance,
mixture, or compound:
(1) That is:
(i) Made in imitation or semblance of a frozen
dessert; or
(ii) Prepared or frozen as a frozen dessert
customarily is prepared or frozen; and
