(d) If after due notice the person for whom the hearing is
held fails or refuses to appear, nevertheless the Secretary may
hear and determine the matter. (E) A PERSON AGGRIEVED BY A FINAL DECISION OF THE SECRETARY
IN A CONTESTED CASE, AS DEFINED BY THE ADMINISTRATIVE PROCEDURE
ACT, MAY TAKE AN APPEAL. 4-427. (a)  Unless the transfer occurs on a dairy farm or in a
receiving station, transfer station, or milk plant, a person may
not transfer a milk product from a container or milk [truck] tank
TRUCK to another. 4-429. (b)  (1) The Secretary may inspect the property, buildings,
or equipment of any permit holder whose milk product has been
produced, PROCESSED, OR PASTEURIZED outside the Departmental
inspection area. 4-716. (a)  Any person aggrieved by a final decision of the
Secretary in denying or revoking a license may [not appeal to the
Board of Review but may] take a [direct] judicial appeal. 4-801. (b)   "Frozen dessert" means [any]: (1)  Artificially sweetened ice cream; (2)  Artificially sweetened ice milk; (3)  French custard ice cream; (4)  French ice cream; (5)  Frozen custard;
(5) Ice cream;
(7) Ice milk;
(8) Lo-mel;
(9) Mellorine;
(10) Parevine;
(11)  Quiescently frozen confection; (12)  Quiescently frozen dairy confection;
