For the purpose of [these proceedings] A PROCEEDING UNDER
PART III OF THIS SUBTITLE, if the spouse of the alleged drug
addict is the petitioner, a communication to the spouse by the
alleged drug addict is not a confidential communication.
9-639.
When a petitioner under Part V of this subtitle appears
before the court, the court shall:
(3) Advise the petitioner that:
(iv) Before commitment may be ordered, the
petitioner has a right to a [hearing] TRIAL.
10-509.
(a) The Department shall inspect each private, INPATIENT
facility at least once every 6 months and at any other time that
the Department considers necessary.
(b) The Department shall keep a report of each inspection.
(c) The Department shall bring any deficiencies to the
attention of the management of the private, INPATIENT facility.
10-524.
Any person aggrieved by a final decision of the Secretary in
a contested case, as defined in the Administrative Procedure Act,
may:
(1) Appeal that decision to the Board of Review OF
THE DEPARTMENT; and
10-901.
(b) The Secretary shall:
(5) Exercise any other power or duty required to
carry out PART I OF this subtitle.
12-115.
(e) (5) If the court determines that the standard set forth
in paragraph [4] (4) of this subsection is met, the court shall:
(i) Commit the individual to the Department [of
Health and Mental Hygiene]; or
(ii) Modify the conditional release as required
by the evidence.
