SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Natural Resources
4-1004.
(a) (1) A person may not catch oysters or clams for
commercial purposes in the waters of the State unless [he] THE
PERSON first obtains a license.
(2) THE DEPARTMENT SHALL REQUIRE AN APPLICANT FOR AN
OYSTER LICENSE TO INDICATE WHETHER THE APPLICANT WILL USE ANY
DIVING APPARATUS, INCLUDING SELF-CONTAINED UNDERWATER BREATHING
APPARATUS, TO CATCH OYSTERS. ON THIS APPLICATION FOR A LICENSE
TO CATCH OYSTERS, THE DEPARTMENT SHALL REQUIRE THE APPLICANT TO
GIVE THE APPLICANT'S ADDRESS AND TELEPHONE NUMBER.
(3) A person may catch up to 1 bushel each of oysters
and clams a day for his own use and consumption without a
license, in places and at times prescribed by rule or regulation
of the Department.
(4) The licensing requirements of this subsection do
not apply to a person catching clams commercially by hydraulic
dredge that is licensed pursuant to subsection (c) OF THIS
SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
