soft-shell clams, and
(7) Protection of soft-shell clams from
contamination, or from deterioration as a result of excessive
heat.

In addition to any other penalty provided in this title, the
Department may suspend or revoke a hydraulic clam dredge license
upon conviction of the licensee or his agent of more than two
violations in any license year of the provisions of this subtitle
relating to soft-shell clams, after due hearing on at least ten
days' notice to the licensee.]
4-1041.
[(a)] A person in charge of any boat or vessel rigged for
catching surf clams or ocean quahogs shall obtain a license from
the Department before he catches any surf clams in the waters of
the State or lands any surf clams or ocean quahogs in the State.
[The license is valid for the year in which it is issued. The fee
to issue and renew the license is $5.
(b) A nonresident of the State may not obtain a license to
catch surf clams. However, a nonresident may obtain a license to
land surf clams or ocean quahogs in the State. The fee for this
license is $25.]
4-1116.
[(b) Any lessee desiring to catch oysters from any leased
oyster bottom by dredge or handscrape shall apply annually to the
Department for a special license, and shall pay a fee of $15.
However, a special license is not required in Worcester County.]
(d) (1) In that water area in Somerset County of Pocomoke
Sound and Pocomoke River, east of Tull's Point, and Marumsco
natural oyster bar eastward to William's Point, a lessee may
authorize a nonresident to take oysters by tong as provided by
this section.
(2) The nonresident shall:
(i) Exhibit the written authorization of the
lessee to the Department on demand;
(ii) Obtain a [license] SPECIAL PERMIT to take
oysters from the leased grounds from the Department; and
(iii) Comply with the appropriate provisions of
this article.
