In addition to any other penalty provided in this title, the
Department may revoke or suspend for not less than ten days, any
handscrape, shinnecock rake, or hard-shell clam dredging license,
after a hearing on at least ten days notice to the licensee, on
the following grounds:
(1) The making of any materially false statement in
the application for the license;
(2) The conviction of the licensee of any violation
of the provisions of this subtitle relating to catching
hard-shell clams with a handscrape, shinnecock rake, or hydraulic
or mechanical dredge. A licensee may not catch hard-shell clams
with any shinnecock rake, hydraulic or mechanical dredge, or
similar device, during the period his license is suspended or
revoked.]
4-1027.
(a) A person shall obtain a [clam dealer's] license before
engaging in the business of shipping or selling hard-shell clams
taken from the waters of the State.
(b) This section does not apply to any person selling his
own catch.
[(c) A clam dealer's license may be obtained from the
Department or the clerk of the circuit court of the county where
the person resides.
(d) Every person who applies for a clam dealer's license
shall file an application form furnished by the Department and
containing information the Department requires by rule and
regulation.
(e) Every applicant shall pay a license fee of $25, and in
addition to this sum, SO cents to the issuing clerk of the court,
if application is made to the clerk of the court.
(f) Upon receipt of the required fee, the Department or the
court clerk shall give the applicant a duplicate copy of the
application, which serves as a temporary license for 15 days to
ship or sell hard-shell clams. After issuing the temporary
license, the court clerk shall forward, within 48 hours, the
original copy of the application to the Department. The
Department, by first-class mail, shall send the license to the
applicant. The court clerk shall forward monthly to the
Department a record of every license issued under the provisions
of this section and the fees received from applicants for deposit
to the credit of the Fisheries Research and Development Fund.
(g) Every clam dealer's license is valid for the calendar
year in which it is issued.]
