them from the natural oyster bars of the State. [The dealer's
license fee is $100. A dealer shall obtain a separate license for
each house he operates in which oysters are shucked or otherwise
prepared for market.
(b) The dealers license is valid from September 1 of the
issuing year to August 31 of the succeeding year, inclusive.
(c) Every boat, vessel or vehicle used by a licensed oyster
dealer in purchasing oysters shall be licensed annually for a $10
fee for each boat, vessel, or vehicle. Proof of ownership of the
boat, vessel, or vehicle is required. The Department shall issue
a plate or tag carrying the license number for each boat, vessel,
or vehicle license and it shall be attached securely to the boat,
vessel, or vehicle for which it is issued. The fee is $1 to
replace any license tag issued pursuant to the provisions of this
section.]
[(d)] (B) The Department may not issue [an oyster dealer's]
A license REQUIRED BY THIS SECTION unless the applicant pays all
taxes due for the prior year under § 4-1020 of this subtitle.
[(e)] (C) A person may possess oysters caught from the
natural oyster bars of the State until one week past the close of
the season for taking oysters as established in § 4-1008 of this
article. Oysters may be caught by dredge or handscrape at any
time in Worcester County and may be shipped in the shell at any
time within or from that county. In counties where oysters may be
caught from leased areas at any time pursuant to the provisions
of Subtitle 11, a person may possess oysters at any time.
[(f) Any money received from dealers' licenses shall be
paid over to the Comptroller of the Treasury to be credited to
the Fisheries Research and Development Fund.]
4-1024.
(a) Any person desiring to catch hard-shell clams by
[shinnecock] rake in the waters of Worcester County shall apply
to the Department for a [shinnecock rake] license.
(b) Every applicant shall exhibit to the Department
satisfactory evidence showing the name or number, and size of the
boat. Each applicant shall certify that he is the bona fide
owner of the boat, that a nonresident of the State does not hold
a lien on the boat and that he has been a State resident for at
least one year prior to making the application. The applicant
shall supply any other information the Department requires.
[(c) Upon receiving the application and $10 fee, the
Department shall issue a shinnecock rake license.]
