SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Natural Resources
4-210.
(a) Any person who desires to accept direct or indirect
consideration for providing services as a fishing guide shall
obtain a [commercial fishing guide] license.
[(b) A person desiring a commercial fishing guide license
shall apply annually on forms provided by the Department and pay
a fee of $10. Upon receipt of the application and license fee
the Department may issue the license. A commercial fishing guide
license expires on December 31 each year.]
[(c)] (B) A commercial fishing guide shall be required to
submit reports monthly on forms provided by the Department.
[(d) In addition to any other penalty provided in this
title, the Department may revoke or suspend for a period of not
less than 10 days, any commercial fishing guide license, after a
hearing on at least 10-days notice to the licensee, on the
following grounds:
(1) Making a false statement on an application or
monthly report; or
(2) Failing to submit reports as required.]
4-701.
(A) THIS SECTION APPLIES TO ANY PERSON WHO IS REQUIRED
UNDER SUBTITLES 2, 7, 8, 9, OR 10 OF THIS TITLE TO BE LICENSED TO
GUIDE FISHING PARTIES OR TO CATCH, SELL, BUY, PROCESS, TRANSPORT,
EXPORT, OR OTHERWISE DEAL IN FISH CAUGHT IN TIDAL WATERS.
(B) THE DEPARTMENT SHALL UTILIZE A SINGLE LICENSE, CALLED A
TIDAL FISH LICENSE. A TIDAL FISH LICENSE SHALL AUTHORIZE THE
LICENSEE TO ENGAGE IN EACH ACTIVITY INDICATED ON THE LICENSE.
(C) THE LICENSE YEAR FOR EVERY TIDAL FISH LICENSE SHALL BE
FROM SEPTEMBER 1 THROUGH AUGUST 31 OF THE FOLLOWING YEAR. IN ANY
