LICENSE, AND THE DEPARTMENT SHALL SUSPEND THIS OYSTER HARVESTER
LICENSE ON ISSUANCE OF A POWER DREDGE LICENSE UNTIL ANY TIME THAT
THE HOLDER SURRENDERS THE POWER DREDGE LICENSE TO THE DEPARTMENT.
HOWEVER, IF ANY PERSON WANTS TO REOBTAIN THE PERSON'S PREVIOUSLY
VALID OYSTER HARVESTER LICENSE, THE PERSON SHALL RETURN THE
PERSON'S CURRENTLY VALID POWER DREDGING LICENSE TO THE
DEPARTMENT. THE DEPARTMENT SHALL EXCHANGE AT NO COST THE POWER
DREDGING LICENSE FOR THE PERSON'S FORMER, CURRENTLY VALID OYSTER
LICENSE. (D)  A PERSON MAY CATCH OYSTERS BY POWER DREDGE ONLY DURING
THE POWER DREDGING SEASON FROM NOVEMBER 1, 1982, TO MARCH 31,
1983, AND THEREAFTER FROM NOVEMBER 1, TO MARCH 15 OF THE
FOLLOWING YEAR IN THE WATERS OF THIS STATE THAT LIE CONTIGUOUS TO
SOMERSET COUNTY, INCLUDING ALL OF THE WATERS FROM THE AREA OF
KEDGES STRAITS FROM A LINE DRAWN FROM THE QUICK FLASH BUOY AT FOG
POINT EAST TO SOLOMONS LUMP LIGHT, NORTH TO SHEEPSHEAD POINT, AND
ALONG THE WEST SIDE OF SOUTH MARSH ISLAND TO THE CRAB POT LINE ON
PRY ISLAND. (E)  (1) NOTWITHSTANDING THE PROVISIONS OF § 4-1008(A) OF
THIS SUBTITLE, A PERSON MAY NOT CATCH OYSTERS WITH A POWER
DREDGING LICENSE: (I)  ON SATURDAY OR SUNDAY; OR (II)  BEFORE SUNRISE OR AFTER 3:00 P.M. ON ANY
DAY MONDAY THROUGH FRIDAY. (2) IN ADDITION TO THE PROVISIONS OF § 4-1013 (E) AND
(F) OF THIS SUBTITLE, A PERSON WHO HAS A POWER DREDGING LICENSE
UNDER THIS SECTION: (I)  HAS A LIMIT OF 12 BUSHELS FOR EACH PERSON
OR 24 BUSHELS PER BOAT, WITH A LIMIT OF 2 LICENSED POWER DREDGERS
PER BOAT; AND (II)  MAY USE ONLY A POWER DREDGE BAR THAT HAS A
MINIMUM SIZE OF 36 INCHES UP TO A MAXIMUM SIZE OF 42 INCHES. (F) IF THERE IS SUFFICIENT REASON TO BELIEVE THAT CHANGES
ARE NEEDED TO BETTER CONTROL OR ENHANCE THE OPERATION OF THIS
SECTION, THE SECRETARY MAY ADOPT RULES OR REGULATIONS THAT VARY
OR CHANGE ANY OF THE PROVISIONS OF THIS SECTION. (F) THE SECRETARY MAY ADOPT RULES AND REGULATIONS TO CARRY
OUT THE INTENT OF THIS SECTION. THE RULES AND REGULATIONS
ADOPTED BY THE SECRETARY MAY VARY THE LIMITS ESTABLISHED UNDER
SUBSECTION (E)(2)(I) OF THIS SECTION. 4-1201. (E) ANY PERSON WHO VIOLATES ANY PROVISION OF § 4-1014 OF
THIS SUBTITLE BY USING A POWER DREDGE TO CATCH OYSTERS OUTSIDE OF
THE WATERS OF THIS STATE THAT LIE CONTIGUOUS TO SOMERSET COUNTY,
