LAWS OF MARYLAND
(1)   IS INTOXICATED; (2) IS UNDER THE INFLUENCE OF ALCOHOL; (2) (3) IS SO FAR UNDER THE INFLUENCE OF ANY DRUG,
COMBINATION OF DRUGS, OR COMBINATION OF DRUGS AND ALCOHOL THAT
THE PERSON CANNOT OPERATE A VESSEL SAFELY; OR (3) (4) IS UNDER THE INFLUENCE OF ANY CONTROLLED
DANGEROUS SUBSTANCE, AS DEFINED IN ARTICLE 27, § 277 OF THE CODE,
UNLESS THE PERSON IS ENTITLED TO USE THE CONTROLLED DANGEROUS
SUBSTANCE UNDER THE LAWS OF THIS STATE. (B)  THE EVIDENTIARY REQUIREMENTS OF SECTIONS 10-302 THROUGH
10-306 AND 10-307(A), (B), (C), AND (E) 10-307 OF THE COURTS
ARTICLE ARE APPLICABLE TO ANY VIOLATION OF THIS SECTION. (C)  UNLESS THE PERSON CHARGED WITH ANY VIOLATION OF THIS
SECTION WAS UNAWARE THAT THE ALCOHOL, DRUG, COMBINATION OF DRUGS,
OR COMBINATION OF DRUGS AND ALCOHOL WOULD MAKE THE PERSON
INCAPABLE OF SAFELY OPERATING A VESSEL, IT IS NOT A DEFENSE TO
ANY CHARGE OF VIOLATING THIS SECTION THAT THE PERSON IS OR WAS
ENTITLED TO USE THE ALCOHOL, DRUG, COMBINATION OF DRUGS, OR
COMBINATION OF DRUGS AND ALCOHOL UNDER THE LAWS OF THIS STATE.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983. Approved May 31, 1983.
CHAPTER 576 (House Bill 1015) AN ACT concerning Uninsured Employers' Fund FOR the purpose of providing for staff and a budget for the
Uninsured Employers' Fund; creating an Uninsured Employers'
Fund Board and providing for the membership and the function
of that Board; providing for the appointment and salary of
a Director of the Board; providing that the Board or the
Director of the Board shall assume certain of the functions
of the Workmen's Compensation Commission; providing that the
Uninsured Employers' Fund may enter into a final compromise
and settlement of a claim under certain circumstances;
providing for the funding of the Fund; defining a term;
making certain stylistic changes; and generally relating to
the Uninsured Employers' Fund and the Uninsured Employers'
Fund Board.
