SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article - Natural Resources 4-1005. (a) [A] EXCEPT AS PROVIDED IN § 4-1006(D) OF THIS SUBTITLE,
A person may catch oysters or clams in the waters of the State
only by hand, rakes, tongs, patent tongs, diving apparatus,
dredges, handscrapes, cultch material suspended on strings, in
trays, in bags, or similar devices. Soft shell clams may be
caught by hydraulic or mechanical dredges or rigs. 4-1006. (D) IN THE WATERS OF DORCHESTER COUNTY AND TALBOT COUNTY, A
PERSON MAY NOT CATCH OYSTERS BY USING ANY DIVING APPARATUS. 4-1005. (a) SUBJECT TO RESTRICTIONS PROMULGATED PURSUANT TO THIS
SUBTITLE, A [A] person may catch oysters or clams in the waters
of the State only by hand, rakes, tongs, patent tongs, diving
apparatus, dredges, handscrapes, cultch material suspended on strings, in trays,__in bags, or similar devices. Soft-shell clams may be caught by hydraulic or mechanical dredges or rigs. 4-1011. (F) TO CATCH OYSTERS, A PERSON MAY NOT USE PATENT TONGS,
DREDGES, HAND SCRAPES, DIVING APPARATUS, SCOOPS, SCRAPES, OR ANY
SIMILAR DEVICES AND MAY USE ONLY HAND TONGS IN THE FOLLOWING
WATERS IN KENT, QUEEN ANNE'S, TALBOT, DORCHESTER, WICOMICO, AND
SOMERSET COUNTIES. (1) IN THE CHESTER RIVER, ALL THAT AREA UPRIVER OF A
LINE DRAWN FROM LOVE POINT IN A NORTHEASTERLY DIRECTION TO THE
MOST NORTHWESTERLY POINT ON EASTERN NECK ISLAND, THE KENT NARROWS
BRIDGE DELINEATING THE SOUTHERNMOST BOUNDARY. (2) IN EASTERN BAY: (I) ALL THAT AREA NORTH OF A LINE DRAWN FROM
BENNETT POINT TO THE MOST SOUTHWESTERN END OF PARSONS ISLAND,
THEN TO KENT POINT; THE KENT NARROWS BRIDGE DELINEATING THE
NORTHERNMOST BOUNDARY.
