(D) IT IS THE POLICY OF THIS STATE TO PERMIT THE EXERCISE
OF THE POWERS GRANTED BY THIS SUBTITLE IRRESPECTIVE OF THE FACT
THAT SUCH ACTIVITIES MAY SUPPLANT DISPLACE OR LIMIT FREE ECONOMIC
COMPETITION.
266C.
(f)(1) (I) An Authority shall be created and operated, and
its powers exercised, solely to accomplish 1 or more of the
legislative purposes set forth in this subtitle.
(II) The incorporating county or municipality
may utilize the Authority's exercise of its powers to accomplish
1 or more of the legislative purposes.
(2) (I) AN AUTHORITY OR INCORPORATING COUNTY OR
MUNICIPALITY MAY EXERCISE ITS POWERS IRRESPECTIVE OF ANY EFFECT
ON FREE ECONOMIC COMPETITION.
(II) THE POWERS GRANTED TO THE COUNTY OR
MUNICIPALITY PURSUANT TO THIS PARAGRAPH SHALL NOT BE CONSTRUED:
1. TO GRANT TO THE COUNTY OR MUNICIPALITY
POWERS IN ANY SUBSTANTIVE AREA NOT OTHERWISE GRANTED TO THE
COUNTY OR MUNICIPALITY BY OTHER PUBLIC GENERAL OR PUBLIC LOCAL
LAW;
2. TO RESTRICT THE COUNTY OR MUNICIPALITY
FROM EXERCISING ANY POWER GRANTED TO THE COUNTY OR MUNICIPALITY
BY OTHER PUBLIC GENERAL OR PUBLIC LOCAL LAW OR OTHERWISE;
3. TO AUTHORIZE THE COUNTY OR
MUNICIPALITY OR ITS OFFICERS TO ENGAGE IN ANY ACTIVITY WHICH IS
BEYOND THEIR POWER UNDER OTHER PUBLIC GENERAL LAW, PUBLIC LOCAL
LAW, OR OTHERWISE; OR
4. TO PREEMPT OR SUPERSEDE THE REGULATORY
AUTHORITY OF ANY STATE DEPARTMENT OR AGENCY UNDER ANY PUBLIC
GENERAL LAW.
(1) (1) For the purposes of this subtitle, each county and
municipality is deemed to have all of the powers and discretion
granted in this section to industrial development authorities,
INCLUDING THE POWER TO MAKE LOANS TO PRIVATE ENTERPRISES ENGAGED
IN COMPETITION WITH ENTERPRISES NOT RECEIVING THE LOANS.
(2) THE POWERS GRANTED TO BALTIMORE CITY PURSUANT TO
THIS SECTION SHALL NOT BE CONSTRUED:
(I) TO GRANT TO BALTIMORE CITY POWERS IN ANY
SUBSTANTIVE AREA NOT OTHERWISE GRANTED TO THE CITY BY OTHER
PUBLIC GENERAL OR PUBLIC LOCAL LAW;
