(A) IT IS UNLAWFUL FOR ANY PERSON TO OPEN A SEALED, CLOSED,
OR FASTENED FOOD PACKAGE OR CONTAINER IN ANY MERCANTILE
ESTABLISHMENT FOOD STORE OR SUPERMARKET WHEN SUCH OPENING WILL
LEAVE THE ITEM IN AN UNSALABLE CONDITION, UNLESS THE PERSON HAS
PURCHASED INTENDS TO PURCHASE THE ITEM OR HAS RECEIVED AUTHORITY
TO OPEN THE ITEM BY THE PROPRIETOR.
(B) ANY VIOLATION OF THE PROVISIONS OF THIS SECTION IS A
MISDEMEANOR, AND UPON CONVICTION IS SUBJECT TO A FINE OF NOT MORE
THAN $25.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.

CHAPTER 479
(House Bill 1203)
AN ACT concerning
Draining Land - Boards of County Commissioners
FOR the purpose of authorizing every board of county
commissioners in this State to appoint a board of drainage
viewers to evaluate changes in land use on the request by
the board of managers; authorizing the board of managers to
use the evaluation report as a basis to levy the necessary
tax to maintain drainage improvements; and repealing a
certain reference to taxes levied in a certain proportion.

Preamble
WHEREAS, The Attorney General of Maryland in a letter dated
May 25, 1982 approved House Bill 1479 of the 1982 Session of the
General Assembly for constitutionality and legal sufficiency,
although the Attorney General determined that, due to a
discrepancy between the text and the title of the bill, it could
only be given effect in Caroline County; and
WHEREAS, Being aware of this problem, the Governor signed
House Bill 1479 on June 1, 1982, and the bill became Chapter 910
of the Acts of the General Assembly of 1982; and
