BY repealing and reenacting, with amendments, Article - Education
Section 7-304(d) 26-102(a)
Annotated Code of Maryland
(1978 Volume and 1982 Supplement)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows: Article - Education 7-304. (d) (1) This subsection applies to Prince George's [County]
ST. MARY'S CHARLES, AND CALVERT COUNTIES only. (2) Any student expelled or suspended from school
shall remain away from the school premises during those hours
each school day when the school the student attends is in
session. (3) The expelled or suspended student may return to the school premises during the prohibited hours only for attendance at a previously scheduled appointment, and if the
student is a minor then only if accompanied by his parent or
guardian. (4) Any person who violates any provision of this
subsection is guilty of a misdemeanor and on conviction is
subject to a fine not exceeding $100 for each violation. 26-102. (a) The governing board, president, superintendent, or
principal, of any public institution of elementary, secondary, or
higher education, or a person designated in writing by the board
or any of these persons, may deny access to the buildings or
grounds of the institution to any person who [is not a bona fide,
currently registered student, or staff or faculty member at the
institution, and who does not have lawful business to pursue at
the institution or who acts in a manner that disrupts or disturbs
the normal educational functions of the institution]: (1) IS NOT A BONA FIDE, CURRENTLY REGISTERED STUDENT,
OR STAFF OR FACULTY MEMBER AT THE INSTITUTION, AND WHO DOES NOT
HAVE LAWFUL BUSINESS TO PURSUE AT THE INSTITUTION; OR (2) IS A BONA FIDE, CURRENTLY REGISTERED STUDENT AT
THE INSTITUTION AND HAS BEEN SUSPENDED OR EXPELLED FROM THE
INSTITUTION, FOR THE DURATION OF THE SUSPENSION OR EXPULSION; OR (3) ACTS IN A MANNER THAT DISRUPTS OR DISTURBS THE
NORMAL EDUCATIONAL FUNCTIONS OF THE INSTITUTION.
