concurrent with his membership on the Maryland Commission on
Intergovernmental Cooperation] IS CHOSEN JOINTLY BY THE PRESIDENT
AND SPEAKER AND HAS ICHTHYIC INTERESTS. The third commissioner
shall be appointed by the Governor with the advice and consent of
the Senate. The third commissioner shall be a resident of the
State having knowledge of and interest in marine fisheries
problems. His tenure shall be three years or until a successor is
appointed and qualified.
SECTION 2. AND BE IT FURTHER ENACTED, That the
effectiveness of this Act is contingent upon the enactment of
House Bill 129 of 1983. Should that measure fail of enactment,
the provisions of this Act are null and void without the need of
further action by the General Assembly.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for the
immediate preservation of the public health and safety and having
been passed by a yea and nay vote supported by three-fifths of
all the members elected to each of the two Houses of the General
Assembly, the same shall take effect from the date of its
passage. Approved May 24, 1983.
CHAPTER 437 (House Bill 663) AN ACT concerning Criminal Law - Forfeiture FOR the purpose of providing that a defendant may petition for
the return of forfeited money or currency when the State or
a political subdivision has failed to file a petition for
forfeiture within a certain time; providing that the
defendant must file this petition within a certain time from
the date of final disposition of the criminal proceeding;
providing that unclaimed money or currency will revert to
the proper State or political subdivision treasury; and
generally relating to the forfeiture of money or currency. BY repealing and reenacting, with amendments, Article 27 - Crimes and Punishments Section 297(b) Annotated Code of Maryland (1982 Replacement Volume and 1982 Supplement)
