AN ACT concerning
Certificates of Candidacy - Time of Filing
FOR the purpose of providing a time for filing certain
certificates of candidacy when the filing date occurs on a
legal holiday; providing a date for filing certificates of
candidacy in a special primary election; and providing a
time for filing certificates of candidacy for a special
primary election when the filing date occurs on a legal
holiday.
BY repealing and reenacting, with amendments,
Article 33 - Election Code
Section 4A-3

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 33 - Election Code
4A-3.
Except for certificates of candidacy filed by petition or
write-in candidates and as otherwise provided herein,
certificates of candidacy shall be received and filed in the
office of the appropriate board not later than nine p.m. on the
Monday which is ten weeks or seventy days before the day on which
the primary election should be held under the primary election
law. IF THE FILING DATE SHOULD OCCUR ON A LEGAL HOLIDAY, THE
CERTIFICATES MUST BE RECEIVED AND FILED NOT LATER THAN NINE P.M.
ON THE NEXT REGULAR BUSINESS DAY WHICH IS NOT A LEGAL HOLIDAY.
Certificates of candidacy for an office to be filled by a special
election pursuant to § 22-1(b) of this article, shall be received
and filed in the office of the appropriate board not later than
five p.m. on the [day] MONDAY WHICH IS THREE WEEKS OR TWENTY-ONE
DAYS PRIOR TO the special primary election WHICH is to be held
tinder the Governor's proclamation setting the date for the
special primary election. If the filing date should occur on a
legal holiday, the certificates must be received and filed not
later than [nine] FIVE p.m. on the next regular business day
which is not a legal holiday.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
