1190 LAWS OF MARYLAND
the following aggregate sums as pay and in lieu of allowances and
maintenance: Captains $10.00, first lieutenants $9.00, second
lieutenants $8.00 per day; sergeants -- $6.00 per day; corporals
-- $5.50 per day; privates -- $5.00 per day. While serving on such special guard duty, commissioned
officers, noncommissioned officers and men shall be subject to
the same military rules and discipline that apply when they are
on other active duty, and they may be uniformed and armed as when
on other active duty. From February 1, 1943, until the beginning of the fiscal
year, all officers and men of the Maryland State Guard detailed
to special guard duty shall be paid from the same funds and in
the same manner as those now performing such guard duty have
heretofore been paid. After the beginning of the next fiscal
year, they shall be paid from the funds and in the manner
provided from time to time in the budget.] [67. The Governor shall have the power in case of insurrection,
invasion, tumult, riot, breach of peace or imminent danger
thereof, or to enforce the laws of this State, to order into
service any part of the Maryland State Guard that he may deem
proper. When the militia is on active service, the commanding
officer and his subordinates shall be, and they are hereby
invested with all the authority of sheriffs and deputy sheriffs
in enforcing the laws of this State, and they may cooperate with
the civil authorities, or take entire charge of the situation as
in the judgment of the commanding officer the exigencies of the
case may require.] 74. Enlistment in the MARYLAND State Guard shall be for [one
year] 2 YEARS and may be renewed, provided, however, that [during
the period of the present war] IN THE EVENT THE NATIONAL GUARD IS
CALLED INTO ACTIVE FEDERAL SERVICE, all enlistments shall
continue [for the duration of said war] UNTIL SUCH TIME AS THE
NATIONAL GUARD HAS BEEN RELEASED FROM ACTIVE FEDERAL SERVICE and
six months thereafter unless sooner discharged by proper
authority. The oath to be taken upon enlistment in such forces
shall be substantially in the form prescribed for enlisted [men]
PERSONS of the organized militia, substituting the words
"Maryland State Guard" where necessary. SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983.
