Article 56 - Licenses
157K. (A)  EXCEPT AS PROVIDED IN SUBSECTIONS (B) AND (C) OF THIS
SECTION, ANY RETAIL SERVICE STATION DEALER WHO PROVIDES A PRICE
REDUCTION ON MOTOR VEHICLE FUEL FOR SELF-SERVICE SHALL PROVIDE,
ON REQUEST, REFUELING SERVICES AT A SELF-SERVICE PUMP AT THE
SELF-SERVICE PRICE TO A DISABLED DRIVER DISPLAYING A SPECIAL
DISABLED PERSON'S REGISTRATION PLATE OR A PERMIT ISSUED BY THE
MOTOR VEHICLE ADMINISTRATION UNDER § 13-616.1 OF THE
TRANSPORTATION ARTICLE. (B)  THE PROVISIONS OF THIS SECTION DO NOT APPLY TO RETAIL
SERVICE STATION DEALERS SELLING MOTOR VEHICLE FUEL FROM THE
FOLLOWING FACILITIES: (1)  EXCLUSIVELY SELF-SERVICE STATIONS WHICH HAVE
REMOTELY CONTROLLED GAS PUMPS, WHICH ARE OPERATED BY A SINGLE
CASHIER, AND WHICH DO NOT PROVIDE MOTOR VEHICLE FUEL PUMP
SERVICE; OR (2)  CONVENIENCE STORES THAT SELL GASOLINE THROUGH
REMOTELY CONTROLLED GAS PUMPS AND THAT DO NOT PROVIDE MOTOR
VEHICLE FUEL PUMP SERVICE. (C)  THIS SECTION DOES NOT APPLY TO ANY DISABLED DRIVER WHO
IS REASONABLY CAPABLE OF SERVING HIMSELF OR WHO IS DRIVING A
VEHICLE CARRYING ANOTHER PERSON WHO IS REASONABLY CAPABLE OF
PROVIDING SELF-SERVICE. [157K] 157L.
(A) EXCEPT AS PROVIDED UNDER SUBSECTION (B) OF THIS
SECTION, ANY [Any] person, copartnership or corporation, or any
member, officer, agent or employee of any copartnership or
corporation who shall violate any provision of this subtitle or
aid or assist in the violation, shall be guilty of a misdemeanor
and upon conviction thereof, shall be punishable by a fine of not
more than one thousand dollars ($1,000.00) or imprisonment for
not more than one (1) year or both fine or imprisonment. (B) ANY RETAIL SERVICE STATION DEALER WHO IS CONVICTED OF A VIOLATION OF ANY OF THE PROVISIONS OF § 157K OF THIS ARTICLE IS
SUBJECT TO A FINE OF NOT MORE THAN $25.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1983. Approved May 24, 1983.
