GENERAL REVISOR'S NOTE:

Former Article 43, § 558, which provided a grace period
for hospitals and related institutions immediately after
enactment of the former law, is deleted as obsolete.

Former Article 43, § 568 is deleted as unnecessary in
light of the severability provision in Article 1, § 23 of
the Code.

Former Article 43, § 568A, which transferred the powers
of the Maryland Hospital Commission to the Department of
Health, is deleted as obsolete since the transfer has been
accomplished.

Former Article 43, §§ 568B, 568D, 568F, and 568G, which
provided for loans to renovate hospitals, are deleted since
the General Assembly has not funded this program since
enactment of the former law in 1967.

SUBTITLE 4. HOME HEALTH AGENCIES.
19-401. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(B)  HOME HEALTH AGENCY.

"HOME HEALTH AGENCY" MEANS A HEALTH RELATED INSTITUTION
OR A PART OF AN INSTITUTION THAT:

(1) IS OWNED OR OPERATED BY 1 OR MORE PERSONS,
WHETHER OR NOT FOR PROFIT AND WHETHER AS A PUBLIC OR PRIVATE
ENTERPRISE; AND

(2) DIRECTLY OR THROUGH A CONTRACTUAL
ARRANGEMENT, PROVIDES HOME HEALTH CARE TO A SICK OR DISABLED
