(B) SERVICES.

THIS SUBTITLE APPLIES TO THE PROVISION OF HOME HEALTH
CARE SERVICES BY A HOSPITAL OR RELATED INSTITUTION TO 2 OR
MORE UNRELATED INDIVIDUALS, WHETHER THE SERVICES ARE
PROVIDED DIRECTLY OR UNDER CONTRACT WITH A HOME HEALTH
AGENCY.

REVISOR'S NOTE: This section is new language derived
without substantive change from the third,
fourth, and fifth clauses of former Article 43, §
556(a).

Subsection (b) of this section is revised to
state that this subtitle applies to the
"provision of home health care services", rather
than applying to a hospital or related
institution because it provides these services.
This revision conforms to Department practice,
which regulates provision of these services by
licensed hospitals and related institutions,
since, by virtue of the license under this
subtitle, a license to operate as a home health
agency is not needed. See Subtitle 4 of this
title.

The first clause of former Article 43, § 556(a),
which stated that this subtitle applied to
hospitals and related institutions, is deleted as
unnecessary, in light of the substance of this
subtitle.

19-303. BOARD ESTABLISHED.

THERE IS A STATE ADVISORY BOARD ON HOSPITAL LICENSING
IN THE DEPARTMENT.

REVISOR'S NOTE: This section is new language added to
state expressly that there is a State Advisory
Board on Hospital Licensing in the Department.
