LAWS OF MARYLAND

Ch. 21

"UNRELATED INDIVIDUAL" MEANS ANYONE WHO IS NOT:

(1)  A CHILD, GRANDCHILD, PARENT, GRANDPARENT,
SIBLING, STEPPARENT, STEPCHILD, OR SPOUSE OF THE PROPRIETOR;
OR

(2)  AN IN-LAW OF ANY OF THESE INDIVIDUALS.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 556(f).

The word "proprietor" is substituted for the
reference to an "owner or lessee", for clarity.

REVISOR'S NOTE TO SECTION: Former Article 43, §
556(d)(3), which described home health agencies,
is deleted as unnecessary in light of Subtitle 4
of this title, which provides for licensing of
home health agencies.

Former Article 43, § 556(g), which defined
"patient", is deleted as unnecessary.

Former Article 43, § 556(1), which defined
"Board" to mean the Secretary, is deleted as
unnecessary since, in this revision, the word
"Secretary" is used where appropriate. This
deletion permits the definition of the word
"Board" in this section, to mean the State
Advisory Board on Hospital Licensing.

19-302. SCOPE OF SUBTITLE.

(A) EXEMPTED FACILITIES.

THIS SUBTITLE DOES NOT APPLY TO:

(1)  A HOME THAT OFFERS ONLY DOMICILIARY CARE,
UNLESS THE HOME CARES FOR 4 OR MORE UNRELATED INDIVIDUALS;
OR

(2)  A DISPENSARY OR FIRST AID TREATMENT FACILITY
THAT IS MAINTAINED ONLY TO PROVIDE SERVICES FOR:

(I)  EMPLOYEES OF A COMMERCIAL OR
INDUSTRIAL PLANT;

(II)  EMPLOYEES OR STUDENTS OF AN
EDUCATIONAL INSTITUTION; OR

(III)   INDIVIDUALS IN A CONVENT, COUNTY
HOME, MOTEL, HOTEL, APARTMENT, OR FACILITY, IF THE
INDIVIDUALS ARE ABLE TO LIVE INDEPENDENTLY.
