INSTITUTIONAL OR HOME-TYPE ENVIRONMENT.

(2) "DOMICILIARY CARE" INCLUDES:

(I)   SHELTER;

(II)  HOUSEKEEPING SERVICES;

(III)  BOARD;

(IV)  FACILITIES AND RESOURCES FOR DAILY
LIVING; AND

(V)  PERSONAL SURVEILLANCE OR DIRECTION IN
THE ACTIVITIES OF DAILY LIVING.

REVISOR'S NOTE: This subsection formerly appeared as
Article 43, § 556(j).

In item (2) of this subsection, the former phrase
"but are not limited to" is deleted as
unnecessary in light of the use of the defined
term "includes".

The only other changes are in style.

Defined term: "lncludes"/"including" § 1-101
(E) HOSPITAL.
"HOSPITAL" MEANS AN INSTITUTION THAT:

(1)  HAS A GROUP OF AT LEAST 5 PHYSICIANS WHO ARE
ORGANIZED AS A MEDICAL STAFF FOR THE INSTITUTION;

(2)  MAINTAINS FACILITIES TO PROVIDE, UNDER THE
SUPERVISION OF THE MEDICAL STAFF, DIAGNOSTIC AND TREATMENT
SERVICES FOR 2 OR MORE UNRELATED INDIVIDUALS; AND

(3)  ADMITS OR RETAINS THE INDIVIDUALS FOR
OVERNIGHT CARE.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 556(b) and the second clause of (a), as
that clause related to hospitals.

In the introductory clause of this subsection,
the former phrase "which falls within the
jurisdiction of this subtitle" is deleted as
unnecessary. See § 19-302 of this subtitle.

In item (1) of this subsection, the words
"legally, ethically and professionally
qualified", which formerly modified "physicians",
