18-324. CONTROL OF COMMUNICABLE TUBERCULOSIS.

(A)  EXAMINATION.

A HEALTH OFFICER MAY HAVE AN INDIVIDUAL EXAMINED, IF
THE HEALTH OFFICER KNOWS OR IS NOTIFIED IN WRITING BY A
PHYSICIAN THAT THE INDIVIDUAL:

(1)  IS SUSPECTED OF HAVING TUBERCULOSIS IN A
COMMUNICABLE STAGE; AND

(2)  IN A PUBLIC PLACE, IS EXPOSING OTHER
INDIVIDUALS TO INFECTION.

(B)  REMOVAL FOR TREATMENT.

IF, AFTER THE EXAMINATION, THE HEALTH OFFICER FINDS
THAT THE INDIVIDUAL HAS TUBERCULOSIS IN A COMMUNICABLE
STAGE, THE HEALTH OFFICER MAY ORDER THE INDIVIDUAL TO BE
TAKEN TO AN APPROPRIATE HEALTH FACILITY UNTIL THE CONDITION
OF THE INDIVIDUAL NO LONGER ENDANGERS THE COMMUNITY WHERE
THE INDIVIDUAL LIVES.

(C)  PROHIBITED ACTS; PENALTIES.

(1)  IF AN INDIVIDUAL IS ORDERED TAKEN TO A
HEALTH FACILITY UNDER SUBSECTION (B) OF THIS SECTION, THE
INDIVIDUAL MAY NOT:

(I)  REFUSE TO ENTER THE HEALTH FACILITY;

(II)  BEHAVE IN A DISORDERLY MANNER WHILE
IN THE HEALTH FACILITY; OR

(III)  LEAVE THE HEALTH FACILITY BEFORE
BEING DISCHARGED PROPERLY.

(2)  AN INDIVIDUAL WHO VIOLATES ANY PROVISION OF
THIS SUBSECTION IS GUILTY OF A MISDEMEANOR AND ON CONVICTION
SHALL BE IMPRISONED IN A PENAL INSTITUTION WITH FACILITIES
FOR TUBERCULOSIS TREATMENT UNTIL THE SECRETARY OR THE HEALTH
DEPARTMENT OF BALTIMORE CITY FINDS THAT THE CONDITION OF THE
INDIVIDUAL NO LONGER ENDANGERS THE HEALTH OF THE COMMUNITY.
