18-312. "PUBLIC HEALTH VETERINARIAN" DEFINED.

IN PART III OF THIS SUBTITLE, "PUBLIC HEALTH
VETERINARIAN" MEANS THE VETERINARIAN WHOM THE SECRETARY
DESIGNATES AS RESPONSIBLE FOR THE VETERINARY PUBLIC HEALTH
PROGRAM OF THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 615(a) and (d).

Former Article 43, § 615 (b), (c), (c-1), and
(f), which defined the terms "county",
"Department", "health officer", and "Secretary",
is deleted as unnecessary in light of the
definitions of those terms in § 1-101 of this
article.

Former Article 43, § 615(e), which defined the
term "rabies", is deleted as unnecessary.

"Secretary" § 1-101

18-313. STATEWIDE SYSTEM.

THE SECRETARY OF HEALTH AND MENTAL HYGIENE SHALL
PROVIDE A STATEWIDE SYSTEM:

(1)  TO CONTROL RABIES;

(2)  TO TREAT EACH INDIVIDUAL WHO IS EXPOSED OR
SUSPECTED OF HAVING BEEN EXPOSED TO RABIES; AND

(3)  TO DISTRIBUTE, IN ACCORDANCE WITH THE
CONDITIONS SET BY THE SECRETARY OF AGRICULTURE, THE
BIOLOGICAL PRODUCTS THAT ARE NEEDED TO PREVENT AND TREAT
RABIES.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 615A(a).

Former Article 43, § 615A(b), which enabled the
Secretary to adopt rules and regulations, is
deleted as unnecessary in light of the broad
rulemaking power of the Secretary under §
2-104(b) of this article.

As to the authority of the Secretary of
Agriculture over biological products, see AG §
3-201 et seq.
