In subsection (d)(1) of this section, the former
reference to "any department, division, board,
bureau, {or} commission" is deleted as
unnecessary in light of the broad reference to an
"agency".
The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that subsection (e) of this section provides for
fees under this section. It is unclear whether
Title 16 of this article, which generally covers
setting of fees for and collection from
recipients of services, also is intended to apply
to this section-

18-304. PENALTIES.
A PERSON WHO VIOLATES ANY PROVISION OF § 18-301 OR §
18-302 OF THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND ON
CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $5,000 OR
IMPRISONMENT NOT EXCEEDING 5 YEARS OR BOTH.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 136.
The former minimum penalties of a $100 fine and 1
year imprisonment are deleted to conform to. the
statement of legislative policy contained in
Article 27, § 643 of the Code, which sets forth
the general rules that, notwithstanding a
prescribed minimum penalty, the court
nevertheless may impose a lesser penalty of the
same character.
The former references to a "firm" or
"corporation" are deleted as unnecessary in light
of the use of the defined term "person".
