(D)  ADDITIONAL POWERS.

TO CARRY OUT THIS SECTION, THE SECRETARY:

(1)  ON REQUEST, SHALL RECEIVE THE HELP OF OR
INFORMATION FROM ANY AGENCY OF THIS STATE OR OF A POLITICAL
SUBDIVISION; AND

(2)  MAY CONTRACT FOR ANY NECESSARY SERVICES.

(E)  FEES; EXPENSES.

(1)  THE SECRETARY MAY SET A SLIDING FEE SCHEDULE
FOR SERVICES PROVIDED UNDER THIS SECTION.

(2)  THIS STATE SHALL REIMBURSE A PROVIDER OF
SCREENING AND DIAGNOSIS UNDER THIS SECTION IN THE AMOUNT
THAT THE SCREENING AND DIAGNOSIS EXCEEDS THE TOTAL OF THE
FEE CHARGED FOR THE SERVICE AND OF ALL THIRD PARTY PAYMENTS
FOR THE SERVICE.

(F)  ANNUAL REPORT.

(1)  ON OR BEFORE JANUARY 1 OF EACH YEAR, THE
DEPARTMENT SHALL SUBMIT AN ANNUAL REPORT TO THE GENERAL
ASSEMBLY.

(2)  THE ANNUAL REPORT SHALL CONTAIN:

(I)  THE FINDINGS AND RECOMMENDATIONS OF
THE DEPARTMENT ON THE EFFECTIVENESS, IMPACT, AND BENEFITS OF
THE PROGRAMS UNDER THIS SECTION;

(II)  AN EVALUATION OF EACH PROGRAM; AND

(III)  ANY PROPOSED LEGISLATION THAT THE
DEPARTMENT CONSIDERS NECESSARY AND PROPER.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 33A.

In subsection (a)(2)(i) of this section, the word
"cancer" is substituted for the reference to any
"malignant condition", for consistency.
Similarly, in subsection (b) of this section, the
reference to "any other malignancy" is deleted.

In subsections (b), (c), and (d)(2) of this
section, the former limitation "within the funds
provided by the State budget" is deleted as
unnecessary in light of Article 15A, § 14 of the
Code, which generally prohibits expenditures in
excess of appropriations.
