SUITABLE PLACE FOR THE RECEPTION OF THE SICK IE:

(1)  A PHYSICIAN CERTIFIES THAT THE INDIVIDUAL
HAS AN INFECTIOUS DISEASE THAT ENDANGERS PUBLIC HEALTH;

(2)  THE INDIVIDUAL:
(I) IS STAYING IN A ROOM OCCUPIED BY MORE

THAN 1 FAMILY;

HOUSING; AND

(II)  IS ON BOARD A VESSEL; OR

(III)  OTHERWISE DOES NOT HAVE PROPER

(3) THE ADMINISTRATIVE HEAD OF THE PLACE FOR THE
RECEPTION OF THE SICK CONSENTS TO THE MOVE.

(B)  PAYMENT OF COST.

THE CITY OR COUNTY WHERE THE INFECTED INDIVIDUAL IS
FOUND SHALL PAY FOR THE COST OF MOVING THE INDIVIDUAL.

(C)  PROHIBITED ACTS.

A PERSON MAY NOT WILLFULLY DISOBEY AN ORDER OR OBSTRUCT
THE CARRYING OUT OF AN ORDER OF THE HEALTH OFFICER TO MOVE
AN INDIVIDUAL.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 57, except for the penalty provision of
that section.

In subsection (a)(1) of this section, the defined
term "physician" is substituted for the ambiguous
reference to a "qualified medical practitioner",
for clarity.

In subsection (a)(3) of this section, the term
"administrative head" is substituted for the term
"superintending body", to conform to other
references in this article.

substitution of "health officer" for "health
authority", see the General Revisor's Note to
this title.

As to an individual on board a vessel, see
Article 74, § 16 of the Code, which deals with
detaining a pilot on board a vessel.
