18-105. TOXIC SUBSTANCES.

THE SECRETARY MAY ADOPT PROCEDURES TO OBTAIN
INFORMATION ABOUT DISEASES THAT ARE CAUSED BY TOXIC
SUBSTANCES AND ABOUT THE INCIDENCE OF THESE DISEASES.

REVISOR'S NOTE: This section is new language patterned
after Article 43, '§ 33(b), as that subsection
relates to diseases caused by toxic substances.

18-106. OCCUPATIONAL DISEASES.

(A) APPLICATION TO BALTIMORE CITY.

TO THE EXTENT THAT ANY ACTION UNDER THIS SECTION
APPLIES TO BALTIMORE CITY, THE SECRETARY SHALL ACT JOINTLY
WITH THE BALTIMORE CITY COMMISSIONER OF HEALTH.

(B) GENERAL DUTIES.

THE SECRETARY SHALL:

(1) STUDY OCCUPATIONAL DISEASES AND MEANS TO
PREVENT AND CONTROL THE DISEASES; AND

(2) SUBMIT TO THE GENERAL ASSEMBLY

RECOMMENDATIONS TO PREVENT AND CONTROL THESE DISEASES.

(C) RULES AND REGULATIONS.

AFTER A PUBLIC HEARING BEFORE THE SECRETARY, THE
SECRETARY MAY ADOPT RULES AND REGULATIONS NECESSARY TO
PREVENT AND CONTROL OCCUPATIONAL DISEASES.

(D) INVESTIGATIONS.

THE SECRETARY SHALL:

(1) INVESTIGATE EACH INDUSTRIAL CONDITION THAT
IS SUSPECTED OF CAUSING AN OCCUPATIONAL DISEASE; AND

(2) RECOMMEND MEANS TO CONTROL THE CONDITION.
