LAWS OF MARYLAND

Ch. 21

"determine" is substituted for "examine into",
for clarity.

Also in subsection (a)(2) of this section, the
former reference to examining into the "causes"
of communicable diseases is omitted as
unnecessary in light of the broad duty to
investigate causes of disease under § 18-101 of
this subtitle.

In subsection (b) of this section, the term
"health professionals" is substituted for the
reference to "medical and health professions",
for brevity and consistency with the reference to
health "officers".

Also in subsection (b) of this section, the
former phrase "to the extent that funds are
provided in the State budget" is omitted as
unnecessary in light of Article 15A, § 14 of the
Code, which prohibits expenditures in excess of
appropriations.

The second sentence of Article 43,   § 33(a), which

requires investigation and control   of nuisances,

is revised in Title 10 of    the Health
Environmental Article.

Defined terms: "Secretary" § 1-101
"Health officer" § 1-101

18-104. CANCER.

(A)  INVESTIGATIONS.

THE SECRETARY SHALL INVESTIGATE, IF FEASIBLE, MEANS TO
PREVENT, TREAT, AND CURE CANCER.

(B)  CARCINOGENS.

THE SECRETARY MAY ADOPT PROCEDURES TO OBTAIN
INFORMATION ABOUT CANCERS THAT ARE CAUSED BY CARCINOGENS AND
ABOUT THE INCIDENCE OF THESE CANCERS.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
former Article 43, § 133A(c)(3).

Subsection (b) of this section is new language
patterned after Article 43, § 33(b), as that
subsection relates to cancers.

In subsection (a) of this section, the former
term "malignant diseases" is deleted as
unnecessary in light of the synonym "cancer".
